1.  What is the definition of a business? top

A business is any commercial enterprise, trade, occupation, calling, profession, vocation or activity engaged in, conducted, carried on, advertised, or held out to the public to be a business by any person, his agent or employee for the purpose of gain, benefit or advantage, either direct or indirect, with the principal objective of livelihood and/or profit through repetitive means.

2.  Do I need a business license for childcare?

Yes, you must first get a pending Town of Pahrump Business License. Then you must apply for a State of Nevada Childcare license, which is required when caring for over 4 children, not counting your own. When you receive the childcare license and provide a copy of it to the Pahrump Town Licensing office, you will receive your Pahrump Business License.

3.  Do I need a license if I work out of my home in Pahrump?top

Yes. Businesses operated from the home require a town business license and must comply with the zoning restrictions. They will also require a Nevada State Business License. Contact Nevada Secretary of State at www.nvsos.gov for information. If you are exempt from the Nevada State Business License, you must file for an exempt business license.

4.  Are there any restrictions on where I can do business?

Every business must meet zoning requirements. It is strongly suggested that before signing any lease or rental agreement, you check with the Pahrump Planning Commission to make sure your business activity is appropriate for the zoning. They are located at 250 N Highway 160 and can be reached by phone at 775 751-4033.

5.  Do I need a sales tax permit? top

Nevada law (NRS) section 372 requires that every person, firm, partnership, corporation, etc., engaging in business as a seller of tangible personal property of a kind the retail sale of which is taxable, must apply for a Nevada Sales/Use Tax Permit. To apply or for questions regarding sales tax, contact the State of Nevada, Department of Taxation at 775 688-1295 or 775 684-2000.

6.  I am a state licensed contractor; do I need a business license too?

Any person licensed as a contractor by the State Contractor‘s Board must obtain a Pahrump business license if they are conducting business in Pahrump or based in Pahrump whether or not they are performing construction in Pahrump.

7.  How do I obtain a contractor‘s license?top

Contractors must obtain a license from the State of Nevada, Contractor‘s Board, 2310 Corporate Circle, Suite 200, Henderson. Nevada 89074, 702-486-1100. This contractor‘s license must be obtained before an application can be submitted for a Pahrump Business License.

8.  How can I check to see if a business has an active Pahrump business license?

You may download the Active Pahrump Business Licenses as of the first working day of the current month by going to the Business License page.

9.  Do non profit organizations need a business license?top

Yes. Non-profit corporations will need to supply proof of their non-profit status from the Nevada Secretary of State and submit the documents required. The business license fee for a non-profit organization is $5.00 annually.

10.  I am paid on a “1099” basis; do I need a business license?

Yes. If you are not paid as an employee (reported on a W2 at the end of the year), you are considered independent or self-employed and are required to have a business license.

11.  What about selling food? top

If you will be selling or preparing food, you will need to apply for a health permit from the Bureau of Health Protection Services by calling 702-486-5069 or 1-800-992-0900 (Toll free in Nevada only). You will need a health permit to receive a Pahrump Business License.

12.  How can I file a complaint against a company doing business in Pahrump?

You may use the Business Complaint Form available for download on the Business License page. and deliver, fax, or mail it to the Town Office. However, please be aware that we cannot become involved in civil matters. We cannot recover money for you or force someone to do work for you. We will forward the complaint form to our code enforcement officer to look into the matter. We also suggest that you call the Better Business Bureau at 702 320-4500 or go to their website at:www.vegasbbb.org.

13.  Can I apply over the internet?top

No, because signatures are required. However, you may mail the packet if your signatures are notarized where indicated.

14.  Must I apply in person?

You may apply in person or by mail. If application is made in person, you will save notary fees by signing some forms in the presence of a business license employee.

15.  Do I need a Fictitious Business Name Registration?top

If your business name is anything other than your legal given name (first name, middle initial, last name), or your corporation name is different from your business name, you will need to file a Fictitious Firm Name Form with the Nye County Clerk‘s Office located at the Nye County Courthouse. It is required to be filed prior to obtaining a business license, to be sure that the name you wish to use is not already in use prior to licensing. Also, some banks will not allow you to open a business account without filing the Fictitious Firm Name form.

16.  What is a business license?

A business license is the means whereby the Town of Pahrump grants you permission to engage in the business for which your license is issued. Pahrump Town Ordinance No. 35 requires that you obtain a license when you conduct any business activity within the town even if your business is located OUTSIDE the town limits or you have a business license from another municipality. The business license certificate is evidence only that you have met the Town of Pahrump requirements and that your license fee has been paid. Other permits may be required to operate your business.

17.  Who is required to have a license? top

Any person who conducts business within the town or is based in the Town must obtain a business license on or before the date the business commences. Conducting business in the Town without a license may result in penalties, correction notices, citations or court action.

18.  Why must I pay a fee to do business in the Town of Pahrump?

The fee imposed by the Town of Pahrump is for the purpose of regulating, licensing, controlling and keeping accurate statistics on businesses, to aid in protecting citizens and customers from illegal or unethical business practices thereby contributing to the health, safety and welfare of the citizens and consumers of Pahrump.

19.  How long is a license good for?top

All business licenses issued by the Town of Pahrump are valid for one year. They have to be renewed annually.

20.  What if I have more than one business or more than one location?

Separate licenses must be obtained for each and every business at each location. So if two businesses are at the same location, there must be two business licenses. If one business has two locations, they must have a business license for each location.

21.  I purchased a business. Can I use the business license of the previous owner? top

No. A business license is issued to a particular person, firm or corporation at a particular location to do a particular business and may not be used by any other person, firm, corporation, location or business.

22.  What if I close or sell the business?

If you chose to close or sell your business, please notify us in writing so that we may cancel your license(s). Be sure to include the business name, address, date of closure, owner name and signature of the owner or authorized representative.

23.  Will the Town of Pahrump notify me when it is time to renew my license?top

Yes. However, it is your responsibility to renew the business license on time even if the courtesy reminder is not received. Penalties are assessed for delinquent payments, regardless of whether or not you receive a renewal notice. If you do not receive a renewal notice two weeks prior to the expiration date, contact the Business License Department at 727-5107 Ext 312.

24.  What happens if I pay late?

If payment is not received in the Business License office on or before the due date, a penalty will be assessed after a 10 day grace period. A delinquent notice will be sent notifying you that your license has expired. Please keep in mind that the postmark is not recognized as meeting the receipt requirements.

25.  What if I move the business to another location within the Town? top

Always check with the Pahrump Planning Commission to verify that the new location is zoned properly for the intended use and whether a use permit or other type of approval is required. You must notify our office whenever you change your address, phone number, business activity or ownership. We will be happy to provide you with the information related to the requested changes.

26.  How long will it take to get my business license?

When the application is complete and payment is received, we will issue your business license. Your business license will be mailed to you within a few days. If you bring the paperwork into the office and it is complete, we will give you a copy of the application with the business license number on it to use as a temporary license.

27.  I want to run a temporary business (30 days or less). What do I need to do?

You need to apply for a seller permit. You will still have to have any other requirements, health permit, tax permit, etc. A seller permit is good for a maximum of 30 days.

28.  How can I close my business license?top

Please mark the box on your renewal letter that says “I am no longer doing business in Pahrump; please close my business license account.” Have the principal of the company sign and mail it to the Pahrump Town Office, Attn: Business Licensing Department, 2100 E. Walt Williams Drive, Suite #100 Pahrump, NV 89048.

If you have not received a renewal letter or cannot locate it, please send us a completed Business Closure Form or a letter asking to close your license with the company name, license number and signature of the principal of the company to the above address.

29.  How can I change my Company’s mailing address?

If you are only changing your mailing address (not your physical address) and do not require a reprint of your license, you may complete a Business Change of address form (you do not need to do the planning or fire forms), have it signed by a principal of the company and mail or deliver to the Town Office. If you wish to have a reprint of your license, send the form with a $5.00 check or money order made out to the Town of Pahrump.

30.  How can I change my company’s physical address? top

You will need to submit a Business Change of Address form along with an approved Multi-Purpose Counter Application for the Pahrump Regional Planning District and a $5.00 check for the reprint. If employees, customers or clients are present at your business location, you must also complete the Pahrump Valley Fire Form and include a $50.00 check made out to PVFRS.
